What is a gun trust, and why might you need one? Gun trusts are a smart option for owning and transferring firearms—especially those regulated under the National Firearms Act (NFA) of 1934 and Title II of the Gun Control Act of 1968. While commonly used for NFA-regulated items like suppressors, short-barreled rifles (SBRs), machine guns, and destructive devices, gun trusts can actually be used to hold any type of firearm, including standard rifles and handguns.

These trusts offer several benefits. First, they help streamline the federal transfer process required when buying or passing down NFA firearms. For example, to legally transfer an NFA item to another person—even a family member—you must get approval from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and pay a $200 transfer tax per item (this is called a “tax stamp”). The ATF will also conduct a background check and require fingerprints and photographs of responsible persons named in the trust.

A gun trust can also make things easier for your family after your death. Without one, heirs may face delays, unintentional violations, or even be forced to surrender the firearms. With a trust in place, designated trustees can legally use or possess the firearms without needing to individually transfer them through the ATF—so long as they’re legally allowed to possess firearms under both federal and state law.

It’s important to know that individual states may impose their own restrictions on NFA items or require additional steps. Utah, for example, permits ownership of most NFA items, but still requires full compliance with ATF rules.
