What Is Trade Dress?
Trade dress refers to the visual appearance of a product or its packaging that signals to consumers where it comes from -think of the shape of a Coca-Cola bottle or the interior layout of a national chain restaurant.
Trade dress can include colors, designs, and even store ambiance. Just like a logo or brand name, trade dress can be legally protected if it’s distinctive and not purely functional. Business owners should know that trade dress protection falls under trademark law, and in many cases, it can be registered with the U.S. Patent and Trademark Office (USPTO) for added protection. However, even unregistered trade dress may still be enforceable under federal law if it has acquired distinctiveness.

What Is a Trade Secret?
